These Terms of Sale (“Terms”) govern purchases made through https://www.aptika.ca/ (the “Website”), operated by Aptika Inc. (“Aptika”, “we”, “us”, or “our”). By placing an order through the Website, you agree to these Terms and to the policies referenced below.

1. Orders and Acceptance

An order confirmation only confirms that Aptika has received your order. It does not mean that the order has been accepted or shipped.

Aptika may verify payment, billing, shipping, tax-exemption, product availability, or other order information before accepting an order. We may request additional information, limit quantities, refuse an order, or cancel an order when reasonably necessary, including in cases of suspected fraud, incorrect pricing or product information, restricted products, or unavailable inventory.

If Aptika cancels an item after payment has been collected, the amount paid for that item will be refunded.

2. Prices, Currency, Taxes, and Payment

Prices displayed on the Website are in Canadian dollars. Applicable taxes, shipping charges, and other fees are displayed during checkout whenever they can be calculated online.

Prices, promotions, and product availability may change without notice. If a significant pricing or product-information error is discovered, Aptika will contact you before processing the affected item. You may accept the correction or cancel the affected item for a refund.

Payment must be authorized before an order is shipped. The payment methods displayed during checkout are the methods currently accepted by Aptika.

3. Product Availability and Backorders

Inventory information is updated regularly but may not reflect real-time availability. If an item is unavailable or delayed, Aptika will notify you when reasonably possible.

You may agree to wait for a delayed item or cancel the unshipped item for a refund. Orders containing several products may be shipped separately as described in our Shipping Policy.

4. Order Changes and Cancellations

Contact Aptika as soon as possible to request a change or cancellation. A request cannot be guaranteed after an order has entered processing, been submitted to a supplier, been customized, or shipped.

Special orders, custom-printed products, programmed or encoded products, and other customized products cannot normally be cancelled after production or procurement has begun.

5. Product Information and Compatibility

Aptika makes reasonable efforts to provide accurate product descriptions, images, specifications, prices, and compatibility information. Manufacturers may change products, packaging, specifications, or included accessories without notice.

Product images are provided for reference. Before ordering, customers should verify that the selected product, supply, part, software, or accessory is suitable for their equipment and intended use.

Advice provided by Aptika is based on the information available at the time and does not replace the manufacturer’s written specifications.

6. Warranties, Service, and Technical Support

Products may include a limited warranty provided by the manufacturer. Warranty coverage, duration, exclusions, and procedures vary by manufacturer and product.

Aptika may ask the customer to complete reasonable troubleshooting or obtain a manufacturer support case number before a product is returned. Aptika may also coordinate warranty service with the manufacturer, distributor, or supplier.

Nothing in these Terms excludes or limits any legal warranty, statutory right, or remedy that cannot legally be excluded. Where applicable, a customer may contact Aptika, the manufacturer, or both regarding a defective product.

7. Important Notice for Québec Consumers

For products that may require maintenance or repair, Aptika will provide the applicable information before the purchase is completed concerning the availability of replacement parts, repair services, and information required to maintain or repair the product.

Unless expressly stated otherwise in a product-specific notice, Aptika does not itself guarantee the availability of replacement parts, repair services, or maintenance and repair information.

Availability offered by the manufacturer is separate and may vary by product. When available, information supplied by the manufacturer will be identified in the product-specific notice.

This notice does not limit any legal warranty or consumer right that cannot be excluded under applicable law.

8. Returns, Refunds, Shipping, and Privacy

Returns and refunds are governed by Aptika’s Return and Refund Policy. Shipping and delivery are governed by Aptika’s Shipping and Delivery Policy.

Information about how Aptika collects, uses, and protects personal information is available in our Privacy Policy.

These policies form part of these Terms.

9. Website Content and Trademarks

The Website and its content are provided for general information and purchasing purposes. All trademarks, product names, logos, and service marks belong to their respective owners.

10. Limitation of Liability

To the fullest extent permitted by law, Aptika is not responsible for indirect, incidental, special, punitive, or consequential damages arising from the Website, an order, a delivery delay, or the use or inability to use a product.

This limitation does not apply to liabilities or consumer rights that cannot legally be limited or excluded.

11. Events Beyond Our Control

Aptika is not responsible for delays or failures caused by events reasonably beyond its control, including carrier disruptions, severe weather, natural disasters, labour disputes, supplier delays, customs delays, government actions, power failures, or network outages.

This section does not remove any cancellation or refund right provided by applicable law.

12. Governing Law

These Terms are governed by the laws of the Province of Québec and the applicable federal laws of Canada, without limiting any mandatory consumer protection law that applies in the customer’s province or territory of residence.

13. Changes to These Terms

Aptika may update these Terms by publishing a revised version on the Website. The Terms in effect when an order is placed will apply to that order, except where a change is required by law.

14. General Provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.

These Terms, together with the policies referenced above and any additional terms shown during checkout, constitute the agreement applicable to your order.
